Here It Is! Our First Installment: Voting Smart for Circuit Court Judges

We are proud to offer Back in River City’s comprehensive voters guide to Shelby County’s 2014 Judicial Elections.  It’s L O O N N N G, and early voting begins on Friday, so we are publishing in installments as we complete each section.  The entire guide will appear as a separate tab on our home page.  It includes voter information, including early voting locations and times; information about the ballot and voting in the primaries; a list of our endorsed candidates in each race we are covering; and analysis of how we came to our recommendations.

In these interim blog posts, we will provide our ballot choices and analysis, with links to sources so you can do your own research if you wish. You may download a sample ballot here  (thanks for the great sample, Memphis Daily News!) and begin to make your own selections.

HOW WE MADE OUR CHOICES

For the past five weeks, we have carefully vetted incumbents and candidates. We began with these basic criteria:

Knowledge and Experience. Do they have the education, knowledge and experience to do the job capably, and how do the candidates compare to one another? How do members of the legal community rate them?
Integrity, Reputation and Character. Are they considered truthful and fair-minded by their peers (if sitting judges, by attorneys who appear before them)? Have they been professionally disciplined by the Tennessee Board of Professional Responsibility or Board of Judicial Conduct? Is their personal conduct above reproach? Have they broken any laws?
Work Ethic. Are they punctual, hard working, diligent, prepared for court and focused? If a sitting judge, how much time is spent in the courtroom or in chambers?
Judicial Temperament. Do they have common sense and a calm demeanor? Are they courteous in their dealings with others? Do they exhibit firmness and decisiveness? Do they conduct themselves with humility and respect for others?
Communication Skills. How well do they speak, write, plead (if attorney) and ask insightful questions?

Here’s where we drew our information:

  • extensive online research
  • judicial candidate forums
  • a carefully selected panel of attorneys
  • additional input from attorneys, elected officials and other trusted friends
  • Eddie’s 24 years of legal practice and extensive knowledge of the judicial system
  • (Frequently lively!) discussion between Eddie and me. (We each persuaded the other in at least one race; we could not come to agreement in only one race.)

We selected a panel of respected attorneys well known to us and whom we trust to be fair-minded. The panel’s collective knowledge and experience spans all the courts electing judges in August 2014. They represented both ends (and middle) of the political spectrum. Each panel member completed a questionnaire about judicial candidates in the courts the panelist regularly appears before. Candidates were rated as Adequate, Inadequate or Outstanding for the above criteria. We also conducted confidential personal interviews with several panel members, in which they spoke candidly about the courts and candidates. Some candidates were not known well enough by the panel to be rated on every attribute. Finally, we asked for and received comments from attorneys and elected officials known to us or our friends, who provided additional endorsements and non-endorsements.

Even with the large body of information we gathered, our choices in some races were quite difficult to make. In general, we favored candidates who appear to be better prepared for the job by virtue of experience and training. We also tend to favor new (and capable) blood on the bench versus retaining judges who have had multiple terms in office (especially those of retirement age). We found some candidates to be ill-suited or ill-prepared to hold a judgeship.

As conservatives, we considered strong party affiliations, but race by race, a Shelby GOP endorsement did not trump a better qualified liberal candidate. We did not consider endorsements by the Shelby Co. Democratic Party (those published in the June 12, 2014 edition of the Memphis Flyer or in the leftwingcracker blog) to be creditable. Not only was party infighting so intense that a final list supported by the entire organization has not been released as of this date, but it is clear that endorsements favor candidates’ party loyalty over their credentials and suitability for judicial office.
